Objectives

The Course intends to offer the student a systematic knowledge of penitentiary legislation, refining its critical issues in the face of the needs of implementing the constitutional aims of the sentence, of protecting human rights and finally of real system efficiency

Contents

Analysis of the prison system and of the constitutional and supranational principles relating to the execution of the sentence

Extended Syllabus

Internal, international and European principles of penitentiary law
The "educational" role of the European Court of Human Rights
A system undergoing change: remuneration, re-education, mediation
The prison universe: protagonists vs. deuteragonists
The prisoner: from object to subject, through unfinished paths (i.e .: reform
interrupted)
The prisoner and his rights
The stranger in prison
Support tools and rewards
The prisoner and discipline
The alternatives to prison
The proceedings before the Magistrate and the Supervisory Court

Methods of Provision

Conventional

Teaching Methods

48 hours of frontal lessons, which include: explanation of normative texts, analysis of jurisprudence, detailed examination of individual concrete cases, debates between students on the topic assigned by the teacher and finally penitentiary visits. Attendance is optional.

Evaluation methods

Verification of learning:

Oral exam on the recommended text. The exam, in addition to verifying the knowledge and understanding of the topics covered, has the objective
to verify the critical learning of the topics covered. Correct use of the technical terms of the subject is also necessary to pass the exam.
