The preparatory course in Employment Law in the Bachelor's degree is highly recommended.

Objectives

The course aims to make students of business management fully aware of the collective dimension of labor relations in the company, the necessary dialectic between business and union representatives in the workplace, the constitutional value of the principle of union freedom and the right to strike, the procedures for conducting collective bargaining and matters within its competence, the various forms of worker participation in business decisions and macroeconomic consultation as a key strategic asset to support productivity and innovation objectives of the company and the country system.

Contents

The course aims to provide an institutional framework of the industrial relations system in the light of constitutional and international principles of freedom of association and the right to strike. The topics of the course cover collective subjects, the issue of union representation and representativeness, union activity in the workplace, the collective agreement and collective bargaining, the strike and other forms of union struggle, the legal regulation of the strike in essential public services.

Extended Syllabus

The program covers: the system of national, European and international sources of trade union law, the notion of inter-union system, freedom of association, collective actors, workers' representatives in the workplace, trade union rights in companies and in public administrations, the collective agreement and its different functions, the rules of collective bargaining at different levels, the legal regulation of trade union activity in public work, consultation and European social dialogue, strikes and other forms of trade union struggle, lock-outs, the legal regulation of strikes in essential public services.

The reference text is the seminal manual of Gino Giugni, Diritto sindacale, Cacucci, Bari, last edition, in addition to the materials listed by the teacher in class.

Teaching Methods

The teaching of the Law of Industrial Relations is based on lectures given by the teacher, case studies, analysis and reading of social partners documents, in-depth analysis of current issues, exercises on collective agreements, professional seminars with representatives of business and labour.

Evaluation methods

Verification of learning:

The students who wish to take the exoneration are invited to agree with the teacher on the presentation and discussion of a research paper on a topic covered in class or, alternatively, to organize in small groups a simulation game on the management of a company dispute. The exam (oral) consists of 3-4 questions on the different parts of the program, aimed at evaluating the personal preparation of the student, the ability to systematically frame the topics covered, the property of language and the level of understanding of the functioning of the industrial relations system. The final grade is expressed in thirtieths: the sufficiency is reached with a grade of 18/30. For students who have taken the partial exemption, the oral test will be limited to the review of the residual part of the program.
