Objectives Contents The substantial Roman private law: persons (family and person) and things (property and real rights, successions, obligations and contracts); and, moreover, some further considerations for the law of obligations with special regard to private liability and diligence criteria, the problem of legal transaction and the dialectic between positive law and what is just and equitable
Extended Syllabus Meaning and periods of the Roman law. Most important historic-constitutional characters Sources. Persons: legal status in the family. Property. Real rights. Classifications, categories and modes of original or derivative acquisition of the things. Hereditary succession. Obligations and contracts: typology, effects, successions and non-performance liability. The rule of diligence, legal transaction, positive right and aequitas from Roman legal science to Roman law tradition
